Terms & Conditions

These terms explain the rules that apply when you purchase, use or interact with Webs TT services, including website design, development, hosting, website care and support.

Please read these terms before purchasing or using our services.

By ordering, purchasing or using a Webs TT product or service, approving a quotation or project, or otherwise engaging Webs TT to perform work, you agree to these Terms & Conditions together with any service-specific terms, quotation, proposal, order details or written agreement applicable to your purchase.

01 Clear scope

Your quotation, order or project scope defines the services and deliverables being provided.

02 Payment matters

Services may require payment in advance and overdue accounts may be suspended.

03 Recurring services

Hosting, maintenance and subscriptions may renew according to the billing cycle shown when ordered.

04 Responsibilities

Both Webs TT and the Client have responsibilities for access, content, third-party software and approvals.

Agreement to these Terms

This website is owned and operated by Webs TT LLC (“Webs TT”, “we”, “us” or “our”).

By purchasing, ordering or using any Webs TT product or service, engaging Webs TT for a project or task, or approving a quotation, proposal or order, the Client agrees to be legally bound by these Terms & Conditions.

These Terms & Conditions, together with any applicable quotation, proposal, order, service-specific terms, statement of work, project scope or written agreement, form the agreement between Webs TT and the Client.

If a service-specific written agreement conflicts with these general terms, the service-specific agreement will govern to the extent of that conflict unless expressly stated otherwise.

Definitions

Client

“Client” means the individual, business, company, organization or other entity purchasing, requesting or receiving products or services from Webs TT, including an authorized employee, representative or agent acting on its behalf.

Services

Webs TT services may include, without limitation, website design and development, WordPress support, website diagnostics and repair, website maintenance, website care, hosting, domains, SSL certificates, business email, consulting, e-commerce services and other website-related products or services offered from time to time.

Deliverables

“Deliverables” are the specific products, services, files, configurations, features, work or results that Webs TT agrees to provide for a project, order or task.

Project Scope

The “Project Scope” describes the work, features, services and deliverables included in a project or engagement.

Project Scope & Deliverables

Webs TT may divide a project into stages and identify specific deliverables or milestones for each stage. These may be defined in a quotation, proposal, project brief, order description, ticket, email or other written communication.

A task or project may be considered complete when the Client approves the work or when Webs TT reasonably determines that the work described within the agreed scope has been completed.

Work requested outside the agreed scope, including new functionality, additional revisions or new services, may be treated as additional work and quoted or billed separately.

Proposals, Quotes & Estimates

Estimates

An estimate is an approximation of the time or fees expected to complete a task or project. Unless expressly identified as a fixed price, an estimate is a guide and is not a guaranteed final price.

Quotations and Proposals

Webs TT may provide a quotation or proposal that describes project scope, features, deliverables, charges, schedules or other applicable terms.

Unless another validity period is stated, quotations and proposals may remain open for acceptance for up to 30 days. Webs TT reserves the right to withdraw or amend a quotation before acceptance.

Approval

A Client who approves a quotation, proposal, project, estimate or order verbally, electronically or in writing agrees to pay the applicable charges and be bound by the relevant service terms.

Pricing, Invoices & Payments

PAYMENT INFORMATION Unless expressly stated otherwise, Webs TT pricing is displayed and charged in United States Dollars (USD).

Invoices

Invoices are payable according to the due date and payment terms shown on the invoice, quotation, order or applicable service agreement.

When an invoice is stated to be due on receipt, payment must be made promptly upon issue.

Advance Payment

Certain services, including hosting, website care, maintenance, subscriptions, domain services and other recurring products, may require payment in advance before the applicable service period begins.

Project Balances

Where a project requires an initial payment or deposit, any remaining balance must be paid in accordance with the applicable quotation, invoice or project agreement.

Taxes and Charges

The Client is responsible for taxes, duties or other charges applicable to a transaction where required by law and where not already included in the displayed price.

Recurring Services & Subscriptions

Some Webs TT services are provided on a recurring basis, including hosting, website maintenance, website care, monitoring and other subscription services.

Unless otherwise stated at checkout or in the applicable agreement, recurring charges are billed according to the billing cycle selected when the service is ordered.

Where automatic payment is enabled, the Client authorizes Webs TT and its payment processor to charge the payment method on file for amounts properly due under the applicable recurring service.

Any minimum commitment period, cancellation notice period or other special subscription terms will be disclosed in the applicable product description, checkout, quotation or separate agreement.

Cancelling a recurring payment method does not by itself cancel amounts already due or obligations arising under a minimum-term service agreement.

Suspension, Cancellation & Termination

Non-payment

Webs TT may suspend access to products or services where an invoice is overdue, payment fails or the Client is otherwise in payment default.

Termination by the Client

Subject to any minimum term or service-specific cancellation requirements, a Client may request cancellation of an eligible service through the available client-area or support channels.

Termination by Webs TT

Webs TT may terminate or discontinue services for non-payment, material breach of these Terms & Conditions, unlawful or abusive use of services, security concerns, or another reasonable basis permitted under the applicable service agreement or law.

Termination does not eliminate amounts that became due before termination or amounts payable under an applicable minimum-term agreement.

Refunds

Unless otherwise stated in writing for a specific product or service, payments for services already provided, work already performed, domains, SSL, hosting periods, maintenance periods and digital services are non-refundable.

If a product or service includes a specific refund, cancellation or money-back policy, that policy will be stated in the applicable product description, checkout, invoice or service agreement.

Domains, Hosting & Website Services

Domains

The Client is responsible for selecting an appropriate domain name and for ensuring that its registration and use do not infringe the rights of another party.

Domain registration is subject to the rules, availability and policies of the applicable registrar and registry.

Hosting

Webs TT will use reasonable efforts to maintain the availability of hosting services; however, uninterrupted or error-free operation cannot be guaranteed.

Hosting may depend upon data centres, networks, software, infrastructure and other third-party providers that are not entirely within Webs TT's control.

Client Access

Where elevated server, hosting-control-panel, database, FTP, shell or similar access is supplied to the Client or a third party acting for the Client, Webs TT may limit or exclude responsibility for problems caused by changes performed through that access.

Transfer of Services

Where applicable and provided that the Client has paid all amounts properly due, Webs TT may reasonably assist the Client with transferring an eligible domain or website service to another provider. Additional migration or administrative charges may apply.

Intellectual Property & Portfolio Rights

Client Materials

The Client retains ownership of original content, trademarks, images and other materials supplied by the Client, subject to any third-party rights that may apply.

Webs TT Work

Unless otherwise agreed in writing, rights in work created by Webs TT remain with Webs TT until all amounts due for that work have been paid.

After full payment, the Client receives the rights or licence specified in the applicable project agreement, quotation or service terms for the intended use of the deliverables.

Third-Party Components

Themes, plugins, fonts, stock assets, software, libraries, APIs and other third-party materials remain subject to the intellectual-property and licence terms of their respective owners.

Portfolio Use

Unless otherwise agreed in writing, Webs TT may display completed work, screenshots and project references in its portfolio, proposals, marketing material, educational material and other demonstrations of its work, provided that confidential Client information is not intentionally disclosed.

Third-Party Services

Webs TT may use third-party providers, contractors, software, hosting companies, payment processors, registrars, APIs, themes, plugins or other technology when providing services.

The Client acknowledges that third-party products and services may be governed by separate terms and may be changed, suspended or discontinued by their respective providers.

Webs TT is not responsible for faults, outages, incompatibilities, policy changes or other failures caused solely by a third-party service outside Webs TT's reasonable control.

Client Responsibilities

The Client is responsible for providing accurate information, approvals, content, credentials and other materials reasonably required for Webs TT to perform the requested services.

The Client represents that it has the right to use all text, images, logos, data and other content supplied to Webs TT and will be responsible for claims resulting from unauthorized materials supplied by the Client.

The Client is responsible for reviewing and approving content, spelling, prices, contact information, product information and other business data before or promptly after publication.

Webs TT may refuse to publish or use material that it reasonably believes is unlawful, infringing, malicious or inappropriate for the requested service.

Limited Warranty

Unless a different warranty is stated in writing, Webs TT may provide a limited warranty of up to 90 days for custom website or system development work completed by Webs TT.

The limited warranty applies only to a fault that Webs TT determines resulted from work performed improperly or incompletely by Webs TT and that falls within the agreed project scope.

The warranty does not cover changes made by the Client or another party, third-party software failures, unauthorized plugins or extensions, external service changes, malware introduced after delivery, infrastructure outside Webs TT's control or work that falls outside the original project scope.

New functionality, design changes, enhancements or other work that is not required to correct a covered defect may be separately chargeable.

Search Engines & Third-Party Platforms

Where Webs TT provides search-engine, optimisation, advertising, marketing or related services, no specific ranking, traffic level, conversion level or financial result is guaranteed unless expressly stated in writing.

Search engines, advertising networks, social platforms and similar services are controlled by third parties that may change their algorithms, policies, pricing or systems without notice to Webs TT.

Warranties, Availability & Liability

Webs TT will use reasonable care and skill in providing its services but does not guarantee that every website, server, service, third-party integration or piece of software will operate uninterrupted or without error at all times.

To the extent permitted by applicable law, Webs TT will not be liable for indirect, incidental, special, punitive or consequential loss, including loss of profit, revenue, opportunity, data or business arising from the use or unavailability of products or services.

Nothing in these Terms excludes any right or liability that cannot lawfully be excluded or limited.

Events Outside Our Reasonable Control

Webs TT will not be responsible for delay, interruption or failure caused by circumstances beyond its reasonable control, including widespread internet or telecommunications outages, data-centre failures, natural disasters, acts of government, labour disruptions, cyber incidents affecting third-party infrastructure or similar events.

Privacy & Account Information

Information collected in connection with our website, client accounts and services is handled in accordance with our Privacy Policy and applicable privacy requirements.

Changes to these Terms

Webs TT may update these Terms & Conditions from time to time to reflect changes to services, operations, technology or legal requirements.

The version published on this page will identify the current effective or last-updated date. Material changes affecting an existing fixed-term agreement will be applied subject to the terms of that agreement and applicable law.
